By using Ava's AI assistant service ("Service"), you agree to these Terms of Service. The Service is provided by CM DevLabs LLC ("Ava," "we," "us," or "our").

If you do not agree to these terms, please do not use the Service.

2. Description of Service

Ava provides AI-powered conversation and booking assistance for businesses and their customers. The Service includes:

• AI chat assistant for appointment booking and customer inquiries
• SMS, email, and voice notifications for appointments
• Business dashboard for managing bookings and customer data
• Embeddable chat widget for business websites

3. User Accounts

Business owners must create an account to use the dashboard and management features. You are responsible for:

• Maintaining the confidentiality of your account password
• All activities that occur under your account
• Notifying us immediately of any unauthorized account access
• Providing accurate and current information

4. Acceptable Use

You agree NOT to:

• Use the Service for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service or servers
• Use automated means to access the Service without permission
• Harass, abuse, or harm other users
• Send spam or unsolicited marketing messages

5. Communications and Notifications

By using our Service, you consent to receive communications from us, including:

• Appointment confirmations and reminders via SMS, email, or voice
• Service updates and notifications
• Account and billing information

You can opt out of non-essential communications as described in our SMS Terms and Privacy Policy.

6. Service Availability

We strive to provide reliable service, but we do not guarantee that the Service will be:

• Available at all times without interruption
• Error-free or free from bugs
• Secure from unauthorized access

We may suspend or terminate the Service for maintenance, updates, or other reasons with or without notice.

7. Intellectual Property

The Service, including its software, design, and content, is owned by CM DevLabs LLC and protected by copyright and other intellectual property laws.

You retain ownership of your business data and customer information. We only use it to provide the Service as described in our Privacy Policy.

8. Limitation of Liability

To the fullest extent permitted by law, CM DevLabs LLC shall not be liable for:

• Any indirect, incidental, or consequential damages
• Loss of profits, data, or business opportunities
• Damages resulting from use or inability to use the Service

Our total liability shall not exceed the amount you paid for the Service in the past 12 months.

9. Termination

You may stop using the Service at any time by closing your account in the dashboard settings.

We may terminate or suspend your access to the Service at any time, with or without cause, if you violate these Terms or for any other reason.

10. Changes to Terms

We may update these Terms from time to time. Changes will be posted on this page with a new "Last Updated" date.

Continued use of the Service after changes constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of the State of Michigan, without regard to conflict of law principles.
